Terms of Service

1. Who these terms are between

These Terms are a binding agreement between you and Jennifer Meszaros, carrying on business as Atlas.Earth, a sole proprietorship registered in North Vancouver, British Columbia, Canada (“Atlas.Earth”, “I”, “me”), governing your access to and use of myatlas.earth, the China Low-Altitude Economy Atlas tools, the China eVTOL News newsletter, and any paid subscription (together, “the Service”).

Atlas.Earth is the business. myatlas.earth is the site it operates, and the China Low-Altitude Economy Atlas — referred to throughout these Terms as “the Atlas” — is the product delivered through it.

By subscribing to or using the Service you accept these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” means both you and that organization.

2. What the Service is

The Atlas is an interactive research product built on original reporting published in China eVTOL News. It comprises a set of tools — currently the Funding Monitor, Investor Network, Order Momentum, Geographic Radar, AAM Silk Road Map, and Government Plans — presenting funding rounds, investors, orders, and policy activity in China’s low-altitude economy.

The Atlas is journalism and analysis. It is not investment advice, legal advice, or a regulatory filing. Figures are compiled from company announcements, media reports, regulatory filings, and third-party databases, and are labeled throughout to distinguish disclosed amounts from undisclosed and estimated ones. You are responsible for your own decisions made in reliance on it.

3. Your subscription

3.1 Plans and billing

Individual subscriptions are billed in advance through Stripe on the schedule you select. Team and organization licenses are arranged directly and may be invoiced rather than charged through the checkout. Prices are in US dollars (USD) and exclusive of any applicable taxes. Payment card details, where used, are handled by Stripe and are never stored by me.

3.2 Beta rate

The Atlas is in beta. The Founding Member rate of $799/year is a launch rate offered while the suite is being built out.

The rate you pay applies to the subscription term you purchase. It is not a permanent or lifetime rate. Pricing will rise as the suite grows, and renewals are charged at the rate in effect at the time of renewal.

I will give you at least 30 days’ notice by email before any price increase takes effect on your subscription. If you do not wish to renew at the new rate, you may cancel before your renewal date and you will not be charged.

3.3 Beta status

You acknowledge that the Service is offered in beta. Tools may be added, changed, or withdrawn. Data coverage will expand and figures will be revised as new reporting surfaces and as errors are corrected. I do not guarantee that any particular tool, dataset, company, or feature will remain available during your subscription term.

3.4 Cancellation and refunds

You may cancel at any time. Cancellation takes effect at the end of your current billing period, and you keep full access until then.

Subscription fees are non-refundable, including for partial periods. Where a refund is required by law that applies to you, that law prevails.

3.5 Account security

Each seat is personal to the individual named on it. You are responsible for keeping login credentials secure and for all activity under your account, and — on a team or organization license — for ensuring each seat is used only by the person it is assigned to. Sharing credentials is a material breach of these Terms (see Section 4).

4. License and permitted use

4.1 What you may do

Subject to these Terms and payment of your fees, I grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal business or professional use.

The license covers the number of named individuals your plan provides for — one on an individual subscription, five on a team license, or the number stated in writing on an organization license. Each named user must have their own login, which may not be shared with, or used by, anyone other than the individual it is assigned to.

The license is non-transferable between organizations: it may not be assigned, sublicensed or passed to another business. Within your own organization, seats may be reassigned as your staff change.

You may:

• View, search, filter, and analyze the tools for your own work
• Take a limited number of screenshots or extracts strictly for use inside your own organization — internal memos, investment committee papers, internal presentations — attributed to “China Low-Altitude Economy Atlas / China eVTOL News”

Screenshots and extracts are internal only. They may not be published, posted, broadcast, uploaded, shared with anyone outside your organization, included in any document sent to a client or third party, or reproduced in any article, report, newsletter, deck or social media post. Public reproduction of any kind is governed by Section 4.3 and requires written permission in advance.

“Limited” means, in any rolling 30-day period:

• No more than ten screenshots or extracts in total, all internal
• No more than twenty company records, or the equivalent, from any single tool
• Never a substantial part of any tool, and never enough that a recipient could use the extract in place of a subscription

The internal allowance is not a publication allowance, and it does not accumulate into one. Taking ten screenshots a month and publishing them is a breach of Section 4.3, not compliance with Section 4.1.

Manual re-keying of Service content into your own spreadsheet or database, at any volume beyond the limits above, counts as extraction under Section 4.2 and is not permitted.

4.2 What you may not do

You may not, directly or indirectly:

Redistribution

• Share, sell, resell, sublicense, lease, syndicate, publish, broadcast, or otherwise make the Service or any material portion of it available to any third party
• Share your login credentials, or permit any person other than a named seat holder on your plan to access the Service
• Post Atlas content, screenshots, or exports to any public or shared repository, channel, Slack, Discord, or file-sharing service

Commercialization, competing products, and AI

• Reproduce, republish, repost, transmit, distribute, sell, sublicense, lease, timeshare, display, or otherwise disseminate the Service or any portion of the Service on a systematic, large-scale, commercial, or recurring basis
• Use the Service, or any output, content, screenshot, excerpt, or data derived from the Service, to create, power, train, fine-tune, ground, validate, support, or supply any competing product, index, benchmark, database, analytics offering, newsletter, alert service, AI model, AI training corpus, retrieval system, automated decision tool, or other market intelligence service
• Scrape, harvest, extract, capture, download, export, or store Service content on a bulk, automated, repeated, or systematic basis, by any means including crawlers, spiders, scripts, browser automation, or AI agents
• Incorporate Service content into any product or service you sell, license, or provide to third parties, whether or not for a fee
• Provide Service-derived analysis to clients as a paid deliverable without a separate written license from me

Access controls

• Circumvent, disable, or interfere with the access controls that gate the tools, including the membership authentication layer
• Reverse engineer, decompile, or attempt to extract the underlying source, datasets, or structure of the tools

4.3 Press, media, and citation

Journalists, analysts and researchers may cite the Atlas within the limits below. Attribution alone does not license reuse. Crediting the source satisfies the attribution condition; it does not create a right to reproduce, republish, or commercialize the work.

What you may use without asking

A single article may draw on the Atlas up to these limits:

• Up to five individual data points — a round size, an order volume, a policy date, a company total
• Up to 50 words of written analysis, quoted directly
• No visual output of any kind (see below)

Each use must credit “China Low-Altitude Economy Atlas” in the running text, not only in a caption, footnote or link, and link to myatlas.earth where the format allows. The Atlas must not be the substantive basis of the piece.

This permission may be relied on for two articles in any 30-day period. Beyond that, ask.

What needs written permission first

Email hello@myatlas.earth before publishing any of the following:

• Charts, tables, maps, graphs, screenshots or any other visual output, whole or partial. Screenshotting the Atlas is not permitted, with or without credit.
• Rankings and ordered lists of any kind — the funding and investor leaderboards, country rankings, order-volume rankings — whole or partial
• Rebuilt versions of any chart, table, ranking or dataset, redrawn in your own layout or software
• Any report that is sold, commissioned, sponsored, syndicated, or funded by subscriptions or advertising, regardless of how the Atlas is credited
• Anything exceeding the limits above, or a third article within the same 30-day window
• Presenting Atlas figures as your own research or your own dataset

Sending a draft

Send the relevant passage or graphic to hello@myatlas.earth and I will respond within two working days. Permission is normally granted for accurate, attributed use. It is refused where the extract would remove the reader’s reason to subscribe, or where figures appear stripped of the qualifications that make them meaningful — a floor presented as a total, or an estimate presented as disclosed.

How this interacts with Section 4.2

A report that is sold, or funded by subscriptions, advertising or a commissioning client, is a commercial product. Building one on Atlas content is caught by the competing-product and client-deliverable restrictions in Section 4.2 however the source is credited.

What is actually being protected

Individual facts belong to no one, and nothing here attempts to stop you reporting one. The Atlas is a compilation: the selection, verification and reconciliation of those facts, the provenance notes recording how each was settled, and the charts, rankings and tables that present them. That compilation and its visual output are the protected work, and are what these limits describe.

Press access

Free access for the purpose of writing about the Atlas is available on request. Ask rather than screenshot.

4.4 Commercial, team, and enterprise licensing

The individual license described above is the default and covers internal professional use only.

If you want to do anything commercial with the Atlas — team or organization-wide access, redistribution, client-facing deliverables, inclusion in a product you sell, API or data-feed access, or any AI or machine-learning use — contact hello@myatlas.earth.

A team license covers five named users at $3,500 per year — each with an individual login, reassignable as your staff change. Organization licenses, covering larger groups or department-wide access, are priced by the size of the organization and quoted on request.

Rates quoted here are the founding beta rates and apply to the term purchased, on the same basis as Section 3.2.

The individual, team and organization licenses all cover internal use only. Redistribution, client-facing deliverables, inclusion in a product you sell, API or data-feed access, and any AI or machine-learning use are not covered by any of them, at any seat count, and are licensed separately.

4.5 Unauthorized use — charges and remedies

These are liquidated damages, not a penalty. The sums below are a genuine pre-estimate of loss agreed in advance, because that loss is real but difficult to quantify after the event: once figures are published or a dataset is copied the value cannot be recalled, subscriptions not taken cannot be traced, and license revenue foregone cannot be recovered by any other means.

The unit

Throughout this section, “one annual subscription” means one annual individual subscription at the list rate in effect on the date the unauthorized use began — $799 at the date of these Terms. It does not mean a team or organization license, and it is not varied by the size of the organization in breach, which is accounted for separately in the floors below.

The sums

Credential sharing and excess users. Where the Service is accessed by, or made available to, more individuals than the seats your plan provides for, or by anyone other than a named seat holder: one annual individual subscription for each user in excess of the seats purchased, per year or part year. On an individual subscription the seat count is one; on a team license it is five; on an organization license it is the number stated in writing.

Sharing a single login between people counts as one excess user for each person beyond the named holder, whether or not they access it at the same time.

Publication or reproduction beyond Section 4.3. Where Atlas content, visual output, rankings or datasets are published, reproduced or rebuilt without the written permission required: the republication license fee that would have applied had permission been sought, and in any event not less than one annual individual subscription, per instance.

Commercial and client-facing use. Where Atlas content is used in a product, report, deck, briefing or engagement that is sold, commissioned, sponsored, syndicated or funded by subscriptions or advertising, the sum payable is the greater of:

• the commercial license fee that would have applied had a license been sought; or
• 35% of the fee charged, or budget allocated, for the engagement or publication in which the content was used; or
• the applicable floor below.

Floors, by size of the organization using the content:

Where the fee or budget is not disclosed within fourteen days of a written request, the percentage limb is assessed on the organization’s published rate card, or the prevailing market rate for comparable work by an organization of that size, and any doubt is resolved against the party withholding the figure.

Why these figures

The value of unlicensed use is set by what the user earned from it, not by what a single subscription costs. A consultancy or manufacturer that builds a deliverable on Atlas content captures a fee unrelated to the subscription price, and a fixed low sum would compensate none of the actual loss.

The loss scales with the size of the organization for reasons that are specific and demonstrable. A large firm circulates the deliverable to a client base that overlaps substantially with the Atlas’s own market, so each unlicensed use displaces not one subscription but the subscriptions of everyone who receives it. It also removes the reason for that firm to license the data itself, in a market where a handful of organizations account for most of the licensable demand. And the exclusivity of a compilation, once it appears inside a widely circulated report, cannot be restored at any price.

The tiered floors reflect that scaling directly, rather than applying one figure to a sole practitioner and a global firm alike.

Adjustment

Either party may demonstrate that actual loss was materially higher or lower than the sum calculated above, in which case the actual figure applies. Liquidated damages paid are credited against any damages subsequently awarded for the same breach. Nothing here limits any other remedy, including injunctive relief under Section 4.7.

Costs

Reasonable costs of investigating and enforcing a breach, including legal fees and the cost of establishing the extent of use, are recoverable in addition.

Access

Access may be suspended or terminated immediately on breach, without refund, whether or not any sum above is claimed.

4.6 Audit and verification

Where there is reasonable cause to believe the Service is being used beyond the license granted, you agree, on fourteen days’ written notice and no more than twice in any twelve-month period:

• To confirm in writing the identity of every individual who has accessed the Service through your subscription
• To identify any publication, report, deliverable, dataset or product in which Atlas content has been used
• To provide copies of the relevant passages, pages or files
• To permit inspection of records reasonably necessary to verify compliance, limited to that purpose

Inspection is conducted at my cost, and any information obtained is used solely to verify compliance and treated as confidential. Where an audit establishes use beyond the license, the reasonable cost of the audit is payable by you, in addition to any sums under Section 4.5.

Refusal or obstruction of an audit conducted under this section is itself a material breach.

4.7 Irreparable harm and injunctive relief

You acknowledge and agree that:

• The Atlas is a compilation whose value depends on it not being replicated or circulated beyond the license granted
• Once content is published, copied, or incorporated into another product, it cannot be recalled, and the harm caused is not capable of being fully remedied by money
• Breach of Section 4.2 or 4.3 would therefore cause irreparable harm for which damages alone are an inadequate remedy
• I am accordingly entitled to seek interim, interlocutory and permanent injunctive relief, and specific performance, in any court of competent jurisdiction, without the need to prove actual damage and without posting security or bond, in addition to any other remedy

This acknowledgment is given as a material inducement to granting the license. It does not bind any court, but records the parties’ agreement on the nature of the harm.

4.8 Enforcement

A breach of Section 4.2 or 4.3 is a material breach, including use beyond the seats or scope your license provides for. Access may be suspended or terminated immediately and without refund, and any remedy in Sections 4.5 to 4.7 may be pursued, together with any other remedy available at law. Failure to enforce any provision on one occasion is not a waiver of the right to enforce it later.

5. Intellectual property

All content in the Service — including the tools, their design, the compiled datasets, the verification notes, the written analysis, and the China eVTOL News archive — is my intellectual property or licensed to me, and is protected by copyright and other applicable law.

Individual facts are not owned by anyone. The compilation, verification, structuring, and presentation of those facts is my work, and that is what these Terms protect. Nothing here prevents you from independently researching the same underlying public facts.

6. Accuracy, verification, and limits

6.1 What I do

Every figure in the Atlas is traced to a source, and the tools show their provenance: what was disclosed, what was estimated, where sources conflict, and which reading I followed. Where a total is a floor rather than a complete accounting, I say so.

6.2 What I do not claim

I do not warrant that the Service is complete, accurate, current, or error-free. In particular:

• Funding amounts, valuations, and order volumes are often self-reported by companies and cannot be independently audited
• Undisclosed rounds are shown as undisclosed and are excluded from totals; totals are therefore floors, not complete figures
• Investor classifications are inferred from names, not from ownership records, and are directional
• Currency conversions use a single fixed reference rate stated in each tool, not the rate at the date of each transaction
• Order and letter-of-intent figures reflect what was announced, and announcements are not contracts

6.3 As-is

The Service is provided on an “as is” and “as available” basis. I make no warranty that it will be uninterrupted, secure, or error-free. To the fullest extent permitted by law, I disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of liability

To the fullest extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, lost opportunity, or loss of goodwill, arising out of or relating to the Service, even if advised of the possibility.

My total aggregate liability arising out of or relating to the Service will not exceed the amount you paid me in the twelve months preceding the claim.

Nothing in these Terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

8. Changes to these Terms

I may update these Terms. If I make a material change, I will notify subscribers by email at least 30 days before it takes effect. If you do not accept the change, you may cancel before it takes effect and I will refund the unused portion of your current term.

9. Termination

You may cancel at any time under Section 3.4. I may suspend or terminate your access for material breach, for non-payment, or if I discontinue the Service. If I discontinue the Service entirely, I will refund the unused portion of your current term.

On termination your license ends immediately. You must stop using the Service and delete any exports or extracts held outside your own internal records.

10. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in it. The courts of British Columbia have exclusive jurisdiction, without prejudice to any mandatory consumer protections available to you where you live.
